Welcome to US BARK Rangers (the "App," "we," "us," or "our"). These Terms of Use ("Terms") govern your access to and use of the US BARK Rangers web application, maps, tools, and related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
You must be at least 18 years old, or old enough to form a binding contract in your jurisdiction, to use the Service. If you are under 18, you may only use the Service with the involvement and consent of a parent or legal guardian. By using the Service, you represent that you meet these requirements.
US BARK Rangers is an independent, community-created tool. We are not affiliated with, endorsed by, sponsored by, or officially connected to the National Park Service (NPS), the U.S. Department of the Interior, any state or local park agency, or any official "Bark Ranger," "B.A.R.K. Ranger," or junior ranger program. Any program names, park names, badges, or references are used for identification and informational purposes only.
Data in the Service is gathered from community sources and public information and may be incomplete, outdated, or inaccurate. We do not warrant or guarantee the accuracy, completeness, or reliability of any park, trail, program, or location information. You are solely responsible for verifying information and for your decisions and safety.
You are responsible for your own safety, the safety of others, and the safety and behavior of your pet(s) at all times. You agree to obey all applicable laws, park rules, leash requirements, and posted regulations, and to follow the B.A.R.K. principles: Bag your pet's waste, Always keep your pet on a leash, Respect wildlife, and Know where you can go. Outdoor activity carries inherent risks; you assume all such risks when using the Service to plan or undertake trips.
Some features require an account. You agree to provide accurate information, to keep your login credentials secure, and to be responsible for all activity under your account. Notify us promptly of any unauthorized use. We may suspend or terminate accounts that violate these Terms or that we reasonably believe are being used for abuse, fraud, or unlawful purposes.
The Service may offer paid or premium features, subscriptions, or one-time purchases. If you purchase a paid feature:
The Service may let you upload or create content, such as photos you watermark or trip notes ("User Content"). You retain ownership of your User Content. By submitting it, you grant us a non-exclusive, worldwide, royalty-free license to host, store, display, and process it solely to operate and improve the Service. You represent that you own or have the rights to your User Content and that it does not infringe anyone's rights or violate any law.
You agree not to: (a) scrape, harvest, resell, or redistribute data from the Service without permission; (b) interfere with or disrupt the Service or its security; (c) attempt to gain unauthorized access to any system or account; (d) upload unlawful, harmful, or infringing content; or (e) use the Service for any unlawful purpose.
The Service, including its software, design, and original content, is owned by us or our licensors and is protected by applicable intellectual property laws. Except for your own User Content, you may not copy, modify, or create derivative works from the Service without our permission.
THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE," WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, ACCURACY, AND NON-INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, ERROR-FREE, OR SECURE.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS ARISING FROM YOUR USE OF (OR INABILITY TO USE) THE SERVICE, INCLUDING RELIANCE ON PARK OR PROGRAM INFORMATION. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID US, IF ANY, IN THE 12 MONTHS BEFORE THE CLAIM.
You agree to indemnify and hold us harmless from any claims, damages, losses, and expenses (including reasonable legal fees) arising from your use of the Service, your User Content, or your violation of these Terms or applicable law.
We may modify or discontinue features at any time. We may also update these Terms; when we do, we will revise the "Last updated" date, and material changes may be highlighted in the App. Your continued use of the Service after changes take effect constitutes acceptance of the updated Terms.
These Terms are governed by the laws of the State of Florida, without regard to its conflict-of-laws rules. Any disputes will be subject to the exclusive jurisdiction of the state and federal courts located in Florida, unless otherwise required by applicable law.
